Design Agreement
1. Purpose
This Design Agreement defines ownership, rights, and permitted uses of any designs, models, sketches, or files exchanged between Zion Forged and the Client. The intent is to protect the creative work of both parties while maintaining transparency in how designs are created, shared, and used.
2. Customer-Provided Designs
Any design, sketch, CAD file, drawing, or reference model provided to Zion Forged by the Client remains the sole property of the Client. Zion Forged will not claim ownership, resell, distribute, or reproduce these designs except as required to complete the requested work.
3. Zion Forged Original Designs
When Zion Forged develops a design or model from its own concept, expertise, or solution — without using customer-supplied intellectual property — that design remains the property of Zion Forged. Zion Forged may reproduce, modify, sell, or display that design for future commercial use unless otherwise agreed in writing.
4. Paid Design Transfers
If the Client compensates Zion Forged specifically for the creation and ownership of a design, model, or CAD file, then full rights and ownership of that design are transferred to the Client upon final payment. Zion Forged will retain only the right to display the work for marketing and portfolio purposes unless the Client requests otherwise in writing.
5. Custom Commissions
When Zion Forged designs a custom product or part for a Client:
Unless otherwise specified, Zion Forged retains ownership of the design and may offer similar products for sale.
If the Client wishes to obtain exclusive ownership, that must be clearly stated and reflected in the quoted project cost.
6. Marketing & Showcase Use
Zion Forged may photograph, video record, or display images of the design and final product for use in its portfolio, social media, or marketing materials unless the Client opts out in writing before project completion.
7. Confidentiality
Both parties agree to protect any confidential information or proprietary designs shared during the project and not disclose them to third parties without written permission.
8. Agreement Acknowledgment
By purchasing a custom design, submitting a custom request, or providing design files to Zion Forged, the Client acknowledges and agrees to these terms.
